Terms of Service

These Terms of Service ("Terms") govern your access to and use of Rory, our iPhone app, and this website (together, the "Service").

By downloading, accessing, or using Rory, you agree to these Terms. If you do not agree, do not use the Service.

You must be able to form a binding contract in your jurisdiction to use Rory. If you are using Rory on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Rory is not intended for children under 13. If you are under the age required to consent in your region, you may use Rory only with permission from a parent or legal guardian.

Rory is a walking companion app designed to help you track steps, build habits, and stay encouraged. Features may change over time as we improve the product.

Rory is currently offered at no charge on iPhone, unless we clearly state otherwise in the app or on the App Store listing. We may introduce optional paid features in the future, and any purchase will be subject to Apple's payment terms and applicable pricing shown at checkout.

Rory provides general wellness and motivational support. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

Step counts, goals, streaks, and health-related information shown in Rory or on this website are for general informational purposes only. They are not a substitute for professional medical advice. Always consult a qualified healthcare provider before starting or changing an exercise program, especially if you have a medical condition, injury, pregnancy, or other health concern.

Do not use Rory while driving or in situations where distraction could cause harm. Use your own judgment about when and where it is safe to walk or exercise.

Rory may integrate with Apple Health, motion sensors, notifications, and other iOS features or third-party services. Your use of those services is also subject to their own terms and privacy policies.

We are not responsible for third-party services, including Apple, the App Store, or any connected health platform.

You agree not to misuse Rory. For example, you will not:

• Use the Service in violation of any applicable law or regulation.
• Attempt to reverse engineer, scrape, disrupt, or interfere with the Service or its security.
• Upload malware, spam, or harmful code.
• Misrepresent your identity or impersonate another person or organization.
• Use the Service to harass, abuse, or harm others.

If you submit feedback, suggestions, or other materials to us, you grant Rory a non-exclusive, worldwide, royalty-free license to use that feedback to operate and improve the Service without obligation to you.

You retain ownership of any personal content you provide, subject to the rights needed for us to operate Rory as described in our Privacy Policy.

Rory, including its name, branding, character, software, design, and website content, is owned by Rory or its licensors and is protected by intellectual property laws.

We grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial use in accordance with these Terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, RORY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that Rory will be uninterrupted, error-free, accurate, or meet your specific goals or health outcomes.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RORY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Rory and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.

We may suspend or terminate access to Rory if we reasonably believe you violated these Terms or if needed to protect the Service, users, or third parties.

You may stop using Rory at any time by deleting the app. Sections that by their nature should survive termination will continue to apply.

If you downloaded Rory from the Apple App Store, your use is also subject to Apple's applicable App Store terms. Apple is not responsible for providing maintenance or support for Rory, and Apple has no warranty obligation with respect to the app except as required by law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

Except where prohibited, you agree that disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, when appropriate, provide notice in the app or on this site. Continued use after changes become effective means you accept the updated Terms.
